2. Purpose and scope
These T&C apply to all orders of food products (meats, poultry, butcher preparations and other catalogue items) placed via the Boucherie Léopold I website, exclusively for in-store pickup. No home delivery is offered. The site is intended for individual consumers.
3. Acceptance and amendment of the T&C
Any order placed on the site implies full and complete acceptance of these T&C in the version in force on the day of the order. Boucherie Léopold I reserves the right to amend them at any time; the applicable T&C are those published on the site at the time the order is confirmed. Customers are advised to review them before each order.
4. Products, photos and visuals
Products are described and presented with the utmost care. Photographs, illustrations and visuals are purely indicative: they may be staged or retouched and do not constitute a contractual commitment regarding the exact appearance of the prepared item. As meat is a fresh product cut by hand, the appearance, colour and size may vary from one piece to another.
5. Weight tolerance and invoicing
Products are sold by portion or by piece, at the price shown on the site. As meat is a fresh product cut by hand, the actual weight of the prepared piece may vary by ±5% from the indicated weight. Any variation within this margin gives rise to no price adjustment, partial refund or surcharge.
6. Prices
Prices shown on the site are in euros (EUR), all taxes included, with the applicable VAT at the current rate included. Boucherie Léopold I reserves the right to change its prices at any time; products are invoiced on the basis of the rate in force at the time the order is confirmed.
7. Placing and confirming an order
The customer chooses their products, selects a pickup date and time slot, then confirms the order after reviewing the summary. The order becomes firm upon receipt of the confirmation message. Boucherie Léopold I reserves the right to refuse or cancel any order that is clearly abusive, incomplete or subject to a prior dispute.
8. Payment
Payment is made in full online when the order is confirmed, via a secure payment provider. No payment is accepted in store for orders placed on the site: the order is only confirmed and prepared once payment has been received in full. The transaction is processed directly by the payment provider; Boucherie Léopold I never has access to full bank card details.
9. Availability and out-of-stock
Products are offered subject to available stock. In the event of unavailability noticed during preparation, Boucherie Léopold I informs the customer as soon as possible and offers, at the customer’s choice: a refund of the missing product in proportion to the amount paid, or an equivalent substitute product, subject to the customer’s prior agreement.
10. Order pickup
Pickup takes place at 403 Rue Léopold I, 1090 Jette, at the time and on the day chosen when ordering. Pickup at the chosen slot is mandatory.
If an order is not collected at the scheduled time, it is unfortunately considered abandoned. Fresh meat is a perishable product: beyond the chosen slot, we can no longer guarantee the cold chain or food safety. For this reason, the products are then withdrawn from sale and can no longer be handed over later.
In this case, the order cannot be refunded: the amount paid remains acquired by Boucherie Léopold I to cover the preparation and raw materials already committed.
Exceptionally and depending on its possibilities, Boucherie Léopold I may sometimes accept a pickup on the next opening day, provided it is notified quickly. Without news from the customer within 24 hours of the missed slot, the order is however considered abandoned, as the products are perishable, and can no longer give rise to a pickup or a refund. This flexibility remains a commercial gesture and cannot be demanded.
In case of impediment, the customer is invited to notify the shop as soon as possible on 02 307 04 38.
11. Cancellation, up to 24h before pickup
As these are fresh, perishable foodstuffs prepared to order, the right of withdrawal provided for by the Belgian Code of Economic Law does not apply (article VI.53, 4° of the Code of Economic Law).
An order can be cancelled free of charge up to 24 hours before the chosen pickup time. Cancellation is done directly from the confirmation email or by phone on 02 307 04 38. The payment made is then refunded in accordance with article 13.
After this period, the order can no longer be cancelled: preparation has started and raw materials have been committed. The order then remains due in full and the payment remains acquired by Boucherie Léopold I.
12. Inspection at pickup
At the time of pickup, we invite the customer to check their order with us at the counter: nature and quantity of the products, appearance and freshness. This is the right moment to report any reservation or non-conformity, on the spot, before leaving the shop: we can then correct or exchange immediately. From pickup onwards, storage and compliance with the cold chain are the customer’s responsibility.
13. Refunds and store credit
As these are fresh, perishable foodstuffs prepared to order, products are neither taken back nor exchanged once they have left the shop and give rise to no refund, except in the cases exhaustively listed below.
An exchange or refund is granted only in the following cases, exhaustively listed:
- a preparation error attributable to the shop (product or quantity not matching the order);
- a clearly non-compliant or defective product;
- an ordered product being unavailable (proportional refund or substitute product with your agreement);
- cancellation made within the 24-hour period (payment refunded).
No refund is granted, in particular, in the following cases:
- change of mind, personal preference or a wrong choice by the customer;
- a product whose deterioration results from a break in the cold chain, improper storage, freezing or thawing, or handling after pickup;
- a product already opened, consumed or processed;
- an order not collected within the chosen slot (considered abandoned);
- a weight variation within the ±5% tolerance margin;
- a complaint made after the applicable deadline.
This is why freshness and quality are checked with you at the counter, at pickup: once the product has left the shop, these elements can no longer be reliably checked. Where a refund is due (cancellation within the deadline or a missing product established at the counter), the relevant amount is returned to the original means of payment as soon as possible, the actual time depending on the payment provider and the customer’s bank, or, with your agreement, as store credit. This refund concerns only a sum of money; no product is taken back. If you have a real problem with your order, please do not hesitate to contact us: we make it a point of honour to find a fair solution.
14. Conformity and legal guarantee
In accordance with the Belgian Code of Economic Law, the consumer benefits from the legal guarantee of conformity. As these are fresh, perishable foodstuffs, freshness and conformity are checked by eye and at the counter, at pickup (see article 12): this is the only time when the condition of the product still falls under the shop’s responsibility. From pickup onwards, storage and compliance with the cold chain are the customer’s responsibility (see article 15). By way of exception, a genuinely hidden defect, not detectable at the counter and not attributable to storage, transport or the time after pickup, must be reported without undue delay after its discovery; the product must be stored properly and kept intact at the shop’s disposal, together with proof of purchase (order number) and, where applicable, photographs. No defect can be invoked for a product stored outside the required conditions, opened, consumed or processed, nor where the deterioration may result from a break in the cold chain after pickup.
15. Storage and hygiene
Products are prepared according to the hygiene and traceability rules applicable to the butchery sector in Belgium (FASFC). The cold chain must be respected by the customer from pickup: quick transport and storage between 0 °C and 4 °C, or immediate freezing. Boucherie Léopold I cannot be held responsible for any deterioration of the product following a break in the cold chain after pickup.
16. Complaints and mediation
Any complaint regarding an order (nature, quantity, appearance, freshness of the products) is settled at the counter, at the time of pickup, in accordance with articles 12 and 13: this is where we can correct or exchange immediately. Once the product has left the shop, its freshness can no longer be reliably checked, except in the case of the hidden defect provided for in article 14. 17. Liability
REDAA SRL is liable for direct damage resulting from a fault attributable to it. Indirect or immaterial damages, as well as any damage resulting from improper storage or use of the products after pickup, are excluded. Nothing in these T&C limits or excludes REDAA SRL's liability in the event of fraud, gross negligence, harm to life or physical integrity, or in any other case where the law prohibits it.
18. Force majeure
Boucherie Léopold I cannot be held responsible for the total or partial non-performance of its obligations where this results from a case of force majeure, such as in particular: supply shortage, technical failure, fire, bad weather, strike, pandemic, health or administrative restrictions, or any other unforeseeable event beyond its control.
19. Personal data
The processing of personal data in connection with orders is described in our privacy policy.
20. Applicable law and competent courts
These T&C are governed by Belgian law. Failing an amicable resolution, any dispute will be brought before the competent courts in accordance with the applicable legal rules.
